JobBike Bayern: Framework agreement on the provision of bicycles, supplies and digital services
Background
The aim of the client is to do justice to the role model function of the public sector in climate protection and to meet the requirements of the Bavarian state government for climate-neutral administration by 2030 in accordance with Article 3 Paragraph 1 Clause 1 of the Bavarian Climate Protection Act (BayKlimaG) or by 2028 according to § 1 No. 3 a) aa) of the draft law to amend the Bavarian Climate Protection Act (BayKlimaÄndG-E) and the climate neutrality of Bavaria by 2050 according to Art. 2 Para. 2 BayKlimaG or by 2040 according to § 1 No. 2 b) BayKlimaÄndG-E. In addition, the health of the client's employees is to be promoted and, according to the government declaration of July 21, 2021, bicycle traffic is to be increased to around 20 percent by 2025.
To this end, the client intends to introduce an attractive offer by means of a framework agreement on the provision of bicycles by way of leasing through deferred compensation with a cooperation partner as part of the "JobBike Bayern" project.
The essential services include:
- Support in introducing the offer to clients as part of the "JobBike Bayern" project;
- Implementation of a digital ordering and processing process for bicycle leasing by providing and operating an online platform, taking into account the specifications for the client's IT interfaces, in particular by connecting the contractor's online platform to the existing Internet portal "Employee Service Bavaria" of the Free State of Bavaria in accordance with the required functionalities and creation of an IT interface between the online platform of the contractor and the client via the State Office for Finance;
- Provision of bicycles and leasable accessories (e.g. bicycle locks, lights, pedals, etc.) of the employee’s choice from a dealer from the contractor’s network of partners;
- Provision of insurance benefits for defined insured events and handling of incident management as well
- Performance of services such as annual maintenance and inspection services at a dealer from the contractor's network of partners.
The adjustment of the legal framework in the Free State of Bavaria is currently being prepared in order to ensure a legal basis for the deferred compensation for the relevant groups of people at the time of the award.
At the time of this announcement, the contracting authorities assume that the legal basis required for the deferred compensation for the approximately 237,000 civil servants, including the judges, has been adopted and entered into force at the time the contract is awarded.
On the other hand, the clients with regard to collective bargaining employees assume that the necessary legal basis for the deferred compensation for the approx. 154,000 employees will probably only be approved and come into force after the award has been made.
The granting of a contract for the framework agreement and for the retrieval of services for civil servants, including the judges, is subject to the proviso that the corresponding legal basis for the implementation of the deferred compensation has come into force at this point in time. Furthermore, in the event that the framework agreement is awarded, the client reserves the right that the access to services for the employees is optional and only takes place when the corresponding legal basis for the deferred compensation has also come into force for this group of people.
The clients intend to conclude the framework agreement as the basis for the provision of services for a period of six years. The clients reserve the right to call up at least 2,000 up to a maximum of 782,000 individual leasing contracts during the entire term of the framework agreement.
